Larry McCormley is a problem solver. Like many lawyers, he is very analytical and approaches issues as the challenge of solving a puzzle: searching for the alignment in which each piece best fits. We have all braced ourselves, trying not to let the person we have just met see us cringe.  It happens when the one we just met, upon learning we're an attorney, cannot resist the temptation.  Our new friend brightens, braces to speak, and after a slight, last second hesitation, the words gush out:  "How can you tell when an attorney is lying?"...

Imagine that an investor who is a U.S. resident buys a security issued by an English firm.1 Assume that the U.S. Securities Exchange Act governs the transaction. The U.S. antifraud rules protect the U.S. investor, reducing the risk of investing in the security, but these antifraud rules expose the English issuer to risk....

In the 2008 to 2009 judicial calendar, the Arizona Supreme Court decided a total of six non-violent criminal cases. Of these six cases, two decided issues of first impression and three involved issues of “statewide importance.” Although the factual situations—and the legal issues in general—vary drastically, the court clarified the law in each of the six cases....

The Dallas Cowboys' rookie workout session on May 2, 2009 began like any other at the team's practice facility in the Valley Ranch area of Dallas, Texas. However, the usual questions about quarterback Tony Romo's current girlfriend, the off-field problems of Adam "Pac-Man" Jones, and the decision to cut embattled receiver Terrell Owens, were soon replaced by those questioning the team's liability and decision making following a collapse of the team's six-year old practice facility. The Cowboys, like many other teams in recent years, had built a practice "bubble" to provide a field of play for use under any weather condition....

Privacy in this new digital era is becoming increasingly difficult to
maintain. Simple Google searches can unearth mountains of information about our adversaries and their lawyers. So it’s quite paradoxical that federal-court records remain secreted behind electronic paywalls like Westlaw, Lexis–Nexis and PACER. The issues of privacy and public access to court records are at the heart of a new dialogue between the Administrative Office of the United States Courts (AO) and academics at the Princeton University Center for Information Technology Policy....

Quantifying the amount of harm caused by corporate criminal conduct is a difficult if not impossible task.  Part of the difficulty stems from the lack of available data. Another difficulty is that corporate crimes often cause more than just financial harm. Quantifying damage to the environment or the loss of investor-market trust that may follow a highly publicized corporate criminal prosecution is inexact, to say the least. Nonetheless, there is little doubt that “U.S. citizens and businesses lose billions of dollars each year to criminals engaged in nonviolent fraudulent enterprises.”

There is a genuine concern about the availability of funds for the long-awaited and much anticipated real estate market recovery in Arizona.  With the literal collapse of the savings and loan industry and the current problems being experienced by the banks, these traditional sources of financing cannot now play the role that they did in the past.  The apparent redlining by many out of state lenders and investors has magnified the problem....
