Indian Law

Tiffany & Bosco’s attorneys frequently help businesses and individuals navigate and comply with legal requirements related to doing business, and enforcing creditor’s rights, on tribal land.  Although the interplay of federal, state, and tribal law can create complex issues, the relationships that we have established over the years help us provide our clients with efficient and effective solutions to their legal issues.

What is Indian Law?

There are about 573 federally recognized tribes, including 21 tribes in Arizona, more than 100 tribes in California, 19 tribes in Nevada, and over 20 tribes in New Mexico. Federal Indian law, in large part, outlines the federal government’s obligations to the tribes, the protections afforded to the tribes, and the federal government’s ever-changing recognition of each tribe’s right to self-govern.  The tribes self-govern, in large part, by adopting their own (and in many cases unique) tribal laws that are sometimes not familiar to those accustomed to the legal systems found in state or federal government. Certain tribal governments, like the Navajo Nation and the Salt River Maricopa Indian Community have sophisticated legal systems that cover several areas of law including criminal, civil, administrative, business, property, gaming, and more.  Other tribal governments rely on the laws of other tribes or even states if the tribal government has no laws to address a particular situation.
